Trusts and Wills to benefit people with a learning disability
We have a particular interest and expertise in advising parents of a son or daughter with a learning disabililty on how to provide for their child after they die through the use of trusts.
Daniel Sheridan is a recognised authority on providing for people with learning disabilities through wills and and trusts and frequently lectures on the subject, both to parents (he is a regular speaker for Mencap and other charities on the topic) and to other solicitors, including through the use of webinars.
A large amount of our work in this area is through referrals from other solicitors who recognise that this is an extremely technical and complex area requiring specialised knowledge.
- Wills, Disability Trusts and Discretionary Trusts. We have experience in structuring Trusts for people with learning disabilities and other special needs so that individuals with learning difficulties or special needs who are on means-tested state benefits can be left an inheritance by parents or other relatives without their access to those benefits being jeopordised. We are also able to structure Wills and Trusts to reduce the risk of vulnerable people in the local area of Kingston, Surrey and South West London being taken advantage of once their parents or guardians have passed away.
- Serving as Trustees of Trusts for people with special needs and learning disabilities. Where we are appointed as a Trustee of a Trust for a person with a learning disability or other special need, we act with sensitivity and compassion and take the time to develop a personal relationship with the beneficiary so that his or her specific needs can be met. We normally only act as a Trustee of Trusts for people in the local area of Kingston, Surrey and South West London, as we feel that our local knowlege is integral to the quality of support we are able to give.
- Court of Protection and Mental Capacity issues. We represent people in proceedings before the Court of Protection and have particular experience in assisting families of people with a disability. Working with highly regarded specialist barristers, we are able to advocate effectively for our clients to help ensure that the best interests of their loved ones are protected.
In addition to the law specifically targeted for those with a special need or learning disability, we have experience and an interest in applying other areas of the law to meet the particular challenges faced by adults and children with learning disabilities or special needs. In particular, we have considerable experience in bringing medical negligence claims and personal injury compensation claims on behalf of people with learning disabilities and special needs.
