Lack of Mental Capacity- contesting a will
Wills are only valid if the maker of the Will had the mental capacity to make the Will at the time it was drafted. This is frequently disputed or contested where a Will was made when the deceased was elderly and unwell, particularly if he or she suffered from a mental illness or condition such as Alzheimer’s disease.
Bringing a Will Claim contesting a will is frequently the best option for families worried about the capacity of the person making the will when the will was made. Contesting wills is a specialist area and it is important to engage a contesting will specialist solicitor.
If someone close to you has recently passed away leaving a Will and you are concerned that the Will was created at a time when the deceased lacked the mental capacity to make a Will, it may be possible to bring a Will Claim disputing the Will.
